Terms and conditions

This is an English translation provided for convenience. If there is any difference between the two versions, the Romanian version prevails.

These terms apply to the use of the website www.profipentrusanatate.ro and to orders placed on it. Before you place an order, you tick a box to confirm that you have read and accept them.

1. Who the seller is

The website is operated by PROFI PENTRU SĂNĂTATE S.R.L., tax ID (CUI) RO 35769300, registered with the Trade Register under number J2016000298103, with its registered office at Str. Ion Băiesu, Bl. C3, Parter, 120037 Buzău, jud. Buzău. The warehouse and offices are at B-dul Eroilor nr. 126, 077190 Voluntari, jud. Ilfov. You can reach us at office@profipentrusanatate.ro and on 0770 299 279.

We distribute medical devices under the operating authorisation issued by the National Agency for Medicines and Medical Devices of Romania (ANMDMR).

2. Who we sell to

We sell to legal entities, institutions and individuals. Some rules apply only to individuals buying outside their professional activity (consumers within the meaning of OUG 34/2014); we say so each time. Partner prices apply only to business accounts registered with us.

3. The products

We sell medical and laboratory consumables, disinfectants, medical supplies, cleaning products, office supplies and stationery, and medical equipment. Medical devices carry the CE marking and have the manufacturer’s declaration of conformity.

Descriptions, images and technical data sheets are those received from the manufacturers. The manufacturer may change the packaging without notifying us. If the product you receive does not match the description, we replace it or refund your money under the conditions on the Returns and warranty page.

4. Prices

Prices are in lei. For each product you see both the price including VAT and the price excluding VAT: the price marked “incl. VAT” includes VAT and the one marked “excl. VAT” does not. VAT is charged at Romania’s standard rate of 21%; where the law provides a reduced rate for a product, that rate applies, and each product’s rate is shown on the invoice. You see the total to pay, with VAT and delivery, before you place your order. Delivery costs and the free delivery threshold are on the Delivery and payment page.

If a price is wrong because of an obvious technical error, we will let you know before delivery. You can keep the order at the correct price or cancel it, and you get back everything you paid.

5. The order and conclusion of the contract

To order, add the products to your cart, fill in the delivery and billing details, choose the payment method, tick your acceptance of these terms and press “Order with obligation to pay”. Until then you can correct the quantities in the cart and the details in the form at any time. The contract is concluded in Romanian.

By placing the order you accept that the contract is concluded at a distance, by electronic means. A contract concluded this way has the effects the law recognises for contracts, under Law no. 365/2002 on electronic commerce. We and you comply with the legislation applicable to such contracts, including, if you are an individual, Government Emergency Ordinance no. 34/2014 on consumer rights. Returns and refunds are covered in section 8.

The minimum order value is 150 lei excl. VAT.

Straight after you place the order, we email you a confirmation that we have received it, together with these terms, the page on the right of withdrawal and the page on the legal guarantee, as they stood on the order date. The order also stays in your account, if you have one.

The order is an offer to buy. The contract is concluded when we confirm your order by email or phone after checking stock or, at the latest, when we hand the parcel to the courier. We may refuse an order if the product is no longer in stock or if the billing details are incomplete; in that case we let you know and refund everything you paid.

6. Payment and invoice

You can pay online by card (Visa, Maestro, Mastercard) through Raiffeisen Bank and the payment processor PlatiOnline: at checkout you are redirected to the Raiffeisen Plationline page, where you enter your card details. They never reach us and we do not store them. We do not charge a fee for card payments.

Companies with a verified tax ID can pay by bank transfer. You can also pay the courier cash on delivery. The details, including the legal limits for cash payments, are on the Delivery and payment page.

We issue the invoice based on the billing details in the order, and it travels with the goods. Company details, especially the tax ID (CUI), must be correct because we issue the invoice on that basis.

7. Delivery

We deliver in Romania by courier under the conditions on the Delivery and payment page. For the Republic of Moldova, the terms are agreed separately for each order. If you are an individual, the risk of loss of or damage to the products passes to you when you, or the person you designate, receive the parcel.

8. Withdrawal, returns and warranty

If you are an individual, you can withdraw from the contract within 14 days of receiving the products, without giving a reason, under the conditions on the “14-day right of withdrawal” page, where you will also find the return form. For products that are not in conformity, you have the two-year legal guarantee of conformity, described on the “Legal guarantee of conformity” page. Both pages are linked from the footer of every page on the site and from the Returns and warranty page.

For legal entities, the right of withdrawal does not apply. We nevertheless accept returns of unsealed products within 14 days of delivery, with our prior agreement. Legal entities benefit from the warranty against hidden defects provided by the Civil Code and from the manufacturer’s warranty. The steps are on the Returns and warranty page.

You receive the money for returned products or for a cancelled order by the same method you paid with, unless we agree otherwise: a card payment is normally refunded to the same card. The deadlines are on the Returns and warranty page.

9. Your account

You are responsible for the details you enter in your account and for keeping your password safe. We may suspend an account used for fictitious or abusive orders.

10. Website content

The texts, our own photographs, the logo and the page structure belong to PROFI PENTRU SĂNĂTATE S.R.L. or to our partners. They may not be copied or republished without our written consent.

The articles in the Useful information section are for guidance only and do not replace the manufacturer’s instructions or the medical protocols of your facility. Use the products according to the label and the instructions for use.

11. Personal data and cookies

You can find out how we use your data on the Personal data processing page, and which cookies we use in the Cookie policy. We do not send you marketing messages without your consent.

12. Force majeure

We are not liable for delays or non-performance caused by force majeure, meaning an external, unforeseeable and unavoidable event. We will let you know as soon as possible and, if the situation continues, you can cancel the order and get your money back.

13. Complaints and disputes

For any problem, write to us at office@profipentrusanatate.ro or call 0769 050 850. We reply within 30 days at most.

If we cannot reach an agreement and you are an individual, you can contact the National Authority for Consumer Protection (ANPC) at anpc.ro and request alternative dispute resolution (SAL) at reclamatiisal.anpc.ro.

The contract is governed by Romanian law. Individuals may also bring proceedings before the court of their place of residence. Disputes with legal entities are settled by the competent courts at our registered office in Buzău.

14. Changes to these terms

We may update these terms. An order is governed by the version in force when you placed it, which is the one you receive by email.
